Gilford Inconsistently Applied its Merging Ordinance

Below are some examples of how the town unmerged non conforming lots in common ownership between 1998 and 2007.  The town refuses to acknowledge its actions and we the TAXPAYERS are paying out the nose in legal fees for the town to CONTINUE to deny their actions.  The Selectman need to act NOW.  Why was the ordinance inconsistently applied and WHY did the town attorney offer a very different picture to the Belknap Superior Court and the NH Supreme Court when it came to this ordinance and its application.  Did they think they could just bully the Aichinger's and other merging victims?  Isn't it illegal to knowingly present FALSE information to a NH Court?

Note:  The below files contain a summary page, copies of documents found in the property files, pictures of the old tax maps, pictures of the new tax maps and the deeds of the properties.  On the summary page the column marked 'Notes area of Tax card' is a direct cut and past from Wil Corcoran's (the town Assessor) data base.  In some cases he noted the unmerge as the reason for creating the new tax id.  The deeds show the common ownership and then conveyances to different owners or trusts.

Below are two examples of the Gilford Planning Board doing lot line adjustments to non conforming lots in common ownership and not MERGING the lots.  Why is the town defending an ordinance that it has set aside SO many times!  Why do some folks get their property rights and others do not?
