Merging Victims

If you're a New Hampshire property owner, did you know your property lines can
be modified and your land value slashed without you even knowing about it?
It happens because Planning Boards think conformity to the larger lot size is better than protecting your rights as a property owner. Several towns have repealed
their merging ordinances, and still others don't enforce them because according
to our Constitution, cities and towns don't have the authority to change
your property line just because they feel like it. This misguided planning
and land use policy ignores grandfathering, destroys land values, and
hurts the town's tax base. Protect your rights as a property owner.

Stop local governments from trampling on owners rights support SB 406 and END Involuntary Lot Merging in our great state!

Here is a list of a few merging victims (there are many more!).  See for yourself the destruction of land values that this has caused over the last 30 years.

GILFORD WINS!!

REPEAL of Involuntary Lot Merging has occured with the adoption of Article 8 on March 9th 2010.

Free at last, Free at last Thank God Almighty our land is Free at last.

A message to the Gilford Voters who voted YES on Article 8,

Thank you so much! You are true Patriots! You recognized an unconstitutional act that had been committed on members of your community and you responded. This is the land of the free and the home of the brave.

We have received many phone calls, emails and even flowers from our community since the election results were announced. We are all floating on air. There will be justice for these land owners. We were really touched by the land owners who came to visit us at the polls. The stories about how their land got locked up by this ordinance and the economic hardship that it caused them really drove us to campaign even harder to bring in the vote!

How the Gilford Planning and Zoning Boards couldn't see the unfairness and inequity of this ordinance is beyond belief. There appears to be some socialist kool-aid drinking going on down at the town hall. Hopefully this vote will send a clear message to our local government. The Gilford Zoning Ordinances need to be fair, consistently applied and respect property owners rights. We also expect that our town employees tell the truth and when inequities are discovered they quickly bring them to the attention of the Selectman and the local land use boards.

Thanks again Gilford!
Respectfully,

Edward and Barbara Aichinger

(ps) The Selectman should call for a complete investigation as to why ILM was not stopped earlier and WHY IT WAS INCONSISTENTLY APPLIED. In addition once the information was presented that it was inconsistently applied WHY did Town Attorney present a FALSE picture of the ordinance and its application to the Belknap Superior Court and the NH Supreme Court.
